This User Agreement (the "Agreement") describes the terms and conditions by which All Conditions Gear, Inc., co-presenter of the Crazy for Crocs! promotion, offers you to participate in the promotion by submitting video entries for the online video challenge or by voting for your favorite video entries through www.crazy4crocs.com.
PLEASE READ CAREFULLY THE FOLLOWING TERMS AND CONDITIONS. IF AFTER READING THESE TERMS AND CONDITIONS, YOU UNDERSTAND AND ACCEPT THEM, PRESS THE "AGREE" BUTTON; THEREUPON, YOU WILL BE DEEMED TO HAVE AGREED TO BE BOUND BY THE SAID TERMS AND CONDITIONS AND TO FAITHFULLY COMPLY WITH THE SAME.

1. Registration. Information required upon registration for each participant on www.crazy4crocs.com must be accurate and complete. You must update such information as needed in order to ensure that the information remains to accurate and complete.
2. Use of User Name and Password. All Conditions Gear, Inc. assumes that all activities made using your User Name and password are authorized by you.
3. Submission of video entries and online voting. Registered visitors to www.crazy4crocs.com may choose to submit a video entry, vote for a video entry, or both. Upon registration on www.crazy4crocs.com, All Conditions Gear, Inc. allows you to submit video entries to the Crazy 4 Crocs Online Video Challenge. These entries will be screened together with your completed application form to verify that all requirements as specified in the contest mechanics are complied with.
Upon registration, you will also allowed to vote for your favorite videos, subject to the rules specified under the online voting mechanics.
4. License. By registering, you agree that All Conditions Gear, Inc. shall have unlimited and irrevocable rights (including economic, moral and all other rights that may exist in such material) and license to use, display, publish or communicate to the public, permit others (including, without limitation, All Condition Gear, Inc.'s co-brand partners) to publish, the video entries, online and offline, for a fee or otherwise, in whole or in part, throughout the world and in any form, media, or technology now known or later developed without need of any notice, remuneration, compensation, royalties or attribution to you. Nothing herein, however, shall permit All Conditions Gear, Inc. to use the name of the user, or the title of his work, or otherwise to make use of his reputation with respect to any version or adaptation of his/her video entry or entries which, because of alterations therein, would substantially tend to injure his literary or artistic reputation; or to use the name of the user with respect to a video entry he did not create or submit.
5. User Conduct
a. You agree not to submit any entries to www.crazy4crocs.com that (a) infringes any third-party intellectual property or publicity/privacy rights, (b) is knowingly false, and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, threatening, invasive of a person's privacy, or otherwise in violation of any law or regulation, (c) contains any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information, and (d) promotes piracy or other crimes.
b. You agree not to use www.crazy4crocs.com to either advertise or promote commercial endeavors other than Crocs, which includes active links to other sites on the Internet, without permission from the Crazy 4 Crocs secretariat.
c. You agree that you will not incorporate any word in your name, User Name, or video entry title that is defamatory, obscene or profane, or which violates any trademark, service mark, or other proprietary/intellectual property rights of any third party, including, without limitation, that of Crocs or All Conditions Gear, Inc.
d. Assuming the character of another registered user by copying his User Name or by any other means, is not allowed.
e. Sending videos or other content unrelated to the Crazy 4 Crocs promotion is not allowed.
6. Content Filtering.
a. All Conditions Gear, Inc. reserves the right to edit, delete, or prune any and all video entries or other submitted content which, in its sole opinion, violates any of the terms and conditions of this Agreement.
b. All Conditions Gear, Inc. may elect, at its sole discretion, to monitor some, all, or no areas of www.crazy4crocs.com for adherence to these terms and conditions or the official mechanics.
c. Any registered user who feels that a video entry or some other online content is objectionable may request the Crazy 4 Crocs secretariat to remove the said entry or content by email through admin@crazy4crocs.com. Upon receipt of such a request, the Crazy 4 Crocs secretariat will determine, in its sole opinion, if such removal or alteration is necessary. If deemed necessary, the Crazy 4 Crocs secretariat will make every effort to do so, within a reasonable period.
d. All Conditions Gear, Inc. does not endorse or promote any of the ideas, words, or actions contained in any of the submitted video entries or in any other submitted content.
e. All Conditions Gear, Inc. is not responsible for any and all video entries or other online content submitted to www.crazy4crocs.com. All Conditions Gear, Inc. is not responsible for any inaccuracies or other deficiencies in information that may be contained in the video entries.
f. All Conditions Gear, Inc. shall not be liable for any direct, incidental, special, consequential, indirect or punitive damages that result from the use of, or inability to use, any information or material in any of the video entries submitted to www.crazy4crocs.com, nor for any damages that may result from participation in any component of the Crazy 4 Crocs promotion.
7. User Privacy.
a. The Crazy 4 Crocs secretariat collects information during the registration process to operate the site ("Registration Information"). It collects non-personally identifiable information (often referred to as demographic information) such as: country, region or city, zip or postal code, gender, birth date and occupation.
b. Your Registration Information is used only for demographic statistics. The Crazy 4 Crocs secretariat keeps all your Personal Information private and does not share it with any third parties. All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat, will not disclose your Personal Information unless acting under a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of All Conditions Gear, Inc. and other presenters of the Crazy 4 Crocs promotion; (3) enforce the User Agreement; or (4) act to protect the interests of registered users or others.
c. A special registration form during contests/promos may be used for the purpose of gathering demographic information from the contest/promo participants. This information can be shared with the contest/promo sponsors depending on All Condition Gear, Inc.’s agreement with them.
d. If at any time you believe that All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, or the Crazy 4 Crocs secretariat has not adhered to these principles, please notify us by e-mail at admin@crazy4crocs.com and we will use all reasonable efforts to promptly determine and correct the problem.
8. Limitation of Use. All Conditions Gear, Inc. reserves the right to limit the use of www.crazy4crocs.com to any individual or group at any time.
10. No Warranty.
a. All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of any submitted content, information or material in www.crazy4crocs.com.
b. All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat disclaims any responsibility for the deletion, failure to store, misdelivery, or untimely delivery of video entries or other submitted content.
c. All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat disclaims any responsibility for any harm resulting from downloading or accessing any information or material through www.crazy4crocs.com.
d. The www.crazy4crocs.com web site and services are provided "as is," and All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat expressly disclaim all warranties or conditions of any kind (whether express, implied or statutory), including without limitation the implied warranties of title, non-infringement, and fitness for a particular purpose. Without limiting the foregoing, All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat does not promise or warrant to you that any aspect of the web site and system will work properly or will be available continuously.
11. No Liability. In no event shall All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat. be liable to any party for any loss or damage, including but not limited to lost revenues or profits or special, indirect, incidental or consequential damages (howsoever arising, including negligence) arising out of or in connection with the www.crazy4crocs.com website, its services or this Agreement.
12. Access Limits. Without the prior written consent of All Conditions Gear, Inc. , you may not (a) use any automated means to access the site or collect any information from the www.crazy4crocs.com website (including without limitation robots, spiders or scripts), or (b) frame the site, place pop-up windows over its pages, or otherwise affect the display of its pages, (c) reprint, reproduce or use video entries, submitted content, or any other material in part or as a whole.
13. Amendments. All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat reserves the right to amend any of the terms and conditions of this Agreement at any time. Such amended terms and conditions shall be effective when posted at the www.crazy4crocs.com website.
15. Termination. All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat reserves the right to terminate your use of www.crazy4crocs.com. at anytime, with or without notice. Following termination, at its sole option, All Conditions Gear, Inc., other presenters of the Crazy 4 Crocs promotion, and the Crazy 4 Crocs secretariat may remove some or all of your video entries or other submitted content from the www.crazy4crocs.com website or leave it available for public review, without need of notice or approval from you.
16. Governing Law and Venue. This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. In the event of any dispute arising out of or in connection with this Agreement, the venue shall be the proper courts of Pasig City.
